References in these terms of use to "the Programme", "we", "our" and "us" etc. are references to the WHRI-ACADEMY programme as administered by the Programme Office at the William Harvey Research Institute, Queen Mary, University of London in the United Kingdom.
 
This page (together with the documents referred to on it) sets out the terms of use on which you may make use of the Programme's web-based sites or services at http://www.whri-academy.eu (hereafter referred to as "the site"). These terms apply to all users of, and visitors to, our site. Please read these terms of use carefully before you start to use our site. By using our site, you indicate that you accept these terms of use and that you agree to them. If you do not agree to these terms of use, please do not use our site.

Accessing our site  

Due to the nature of the internet the Programme cannot guarantee that our site or the websites to which our site is linked will always be available to you. If the need arises, we reserve the right to amend, suspend or withdraw the site that we provide without notice. The Programme will not be liable if for any reason our site or others are unavailable at any time or for any period.

Password 

If you choose, or are provided with a password or any other login details to access any part of our site, you agree to treat such login information as confidential and not disclose it to any third party; and to ensure that any details supplied to us in order to register access are accurate and to advise us promptly in the event that any such details change.
The Programme has the right to disable any password or login, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with these terms of use.
You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them.

Intellectual Property 

The Queen Mary, University of London is the owner or the licensee of all intellectual property rights in our site, the technical infrastructure relating to them, and in the material published on them. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
Subject to the restrictions set out below, you may download, view and print material from our site for your personal non-commercial use and for internal non-commercial circulation within your organization. No other use is permitted without our prior written consent. In particular, you may not use any part of the materials on our site for commercial purposes without obtaining our prior written consent. 
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
No trade mark, copyright or other proprietary notices contained in or appearing on material from our site should be altered or removed in whole or in part.
The permission to reproduce material does not extend to material identified as belonging to third parties, where you must obtain the permission of the relevant owners before reproducing such material.

Reliance on Information Posted 

Our site has been prepared with the primary aim of providing information for and about the WHRI-ACADEMY Programme, detailing what we do and how we do it, and to support the knowledge management and business process requirements both inside and outside of the Programme. Although the Programme endeavours to ensure that the information on our site is accurate at the time of publication, any of the information on our site may be out of date or incomplete at any given time. If you believe that any information on our site is inaccurate please let the Programme Office know and we will investigate this. The Queen Mary, University of Londondisclaims all liability and responsibility arising from any reliance on information placed on our site/services by any visitor to our site, or by anyone who may be informed of any of its contents. 
Where the Programme makes research papers, personal commentaries, statistical analyses, corporate data and other third party material available on our sites, the Queen Mary, University of London does not control and does not necessarily endorse their contents or findings in any way, and is not responsible for the accuracy or otherwise of such material.

Posting rules

For any visitors to our website who are not existing staff or students at the Queen Mary, University of London, please be aware that your use of our website is subject to the following:
  • Your use of our website means that you accept, and agree to, these Posting rules, which supplement our terms of use of our website.
  • You must comply with the spirit of these Posting rules. They apply to each part of any contribution as well as to its whole.
Contributions must:

Contributions must not:
  • Contain any material which is defamatory of any person;
  • Contain any material which is obscene, offensive, hateful or inflammatory
  • Promote sexually explicit material;

  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other protected characteristic;
  • Infringe any copyright, database right or trade mark of any other person;
  • Be likely to deceive any person;
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • Promote any illegal activity;
  • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
  • Be likely to harass, upset, embarrass, alarm or annoy any other person;
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • Give the impression that they emanate from us, if this is not the case;
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Liability 

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we hereby expressly exclude: 1) all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; 2) any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation, loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and 3) any liability for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
Nothing in these terms of use will operate to limit or exclude our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law. 

Suspension and Termination 

We will determine, in appropriate discretion, whether there has been a breach of these terms through your use of our site. When a breach of these terms has occurred, the Queen Mary, University of London may take such action as we deem appropriate. Failure to comply with these terms constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions: 1) immediate, temporary or permanent withdrawal of your right to use controlled areas of our site; 2) immediate, temporary or permanent removal of any posting or material uploaded by you to our site; 3) issue of a warning to youlegal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; 4) further legal action against you; and 5) disclosure of such information to law enforcement authorities as the Queen Mary, University of London reasonably feels is necessary.
To the extent permitted by law, the Queen Mary, University of London excludes liability for actions taken in response to breaches of these terms. The responses described in these terms are not limited, and we may take any other action we reasonably deem appropriate.

Jurisdiction and Applicable Law 

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although the Queen Mary, University of Londonretains the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and constructed in accordance with the law of England and Wales.
